HOTĂRÂRE

privind trecerea din domeniul public al Municipiului Iasi in domeniul privat al Municipiului Iasi a unor obiecte de inventar de natura mijloacelor fixe amortizate; mijloace fixe de natura obiectelor de inventar amortizate si neamortizate; mijloace fixe amortizate si neamortizate aflate in administrarea S.C.”CET IASI” S.A. - UFET Iasi

(conform HCL 133;136/2002 si 390/2003 RADET Iasi a fuzionat prin absorbtie cu S.C.”CET IASI” S.A.), ce urmeaza a fi casate

Consiliul Local al Municipiului Iași;

Având în vedere inițiativa Primarului Municipiului Iași prin expunerea de motive la proiectul de hotărâre;

Având în vedere Nota de Fundamentare întocmita de S.C.”CET IASI” S.A.;

In conformitate cu OG 112/2000 privind reglementarea procesului de scoatere din functiune, casare si valorificare a activelor corporale care alcatuiesc domeniul public al statului si al unitatilor administrativ - teritoriale;

In conformitate cu art.17 din Legea 213/1998 privind proprietatea publica si regimul juridic al acesteia;

Avind in vedere Hotaririle Consiliului de Administratie si al Adunariii Generale a Actionarilor/2006 al S.C.”CET IASI” S.A. privind aprobarea intocmirii unui proiect de hotarire care va fi inaintat spre aprobare Consiliului Local al Municipiului Iasi, care prevede trecerea din domeniul public al Consiliului Local al Municipiului Iasi, in proprietatea privata a Consiliului Local al Municipiului Iasi, precum si casarea acestor mijloace fixe prevazute in Anexele 1.1.; 1.2.;1.3.;1.4. si 1.5

Având în vedere rapoartele de avizare întocmite de:

- Comisia economico - financiară a Consiliului Local Municipal Iași;

- Comisia juridică și de disciplină a Consiliului Local Municipal Iași;

In temeiul art.38 și art.120 alin.1 lit.b din Legea nr.286/2006 privind

modificarea și completarea Legii administrației publice locale nr.215/2001;

HOTĂRĂȘTE:

Art.1 Se trec din domeniul public al Municipiului Iași în domeniul privat al Municipiului Iași a unor obiecte de inventar de natura mijloacelor fixe amortizate; mijloace fixe de natura obiectelor de inventar amortizate și neamortizate; mijloace fixe amortizate și neamortizate aflate în administrarea S.C.”CET IASI” S.A.( UFET Iași - conform HCL 133;136/2002 si 390/2003 RADET Iași a fuzionat prin absorbție cu S.C.”CET IASI”S.A.), cuprinse in Anexele 1.1.;1.2.;1.3.;1.4. si 1.5. la prezenta hotărâre.

Art.2 Acestea vor fi casate iar sumele rezultate din valorificarea lor, după deducerea cheltuielilor aferente, se constituie venit la bugetul local.

Art.3 Prezenta hotărâre va fi dusă la îndeplinire de serviciile de specialitate.

Art.4 Prezenta hotărâre va fi comunicata S.C.”CET IASI”S.A.
