privind trecerea din domeniul public în domeniul privat al municipiului Bacău a unor bunuri - mijloace fixe date în concesionare către SC CET SA Bacău

CONSILIUL LOCAL AL MUNICIPIULUI BACĂU

Având în vedere:

- Prevederile art. 10(1) și (2) din Legea nr. 213/ 1998 privind proprietatea publică și regimul juridic al acesteia, cu modificările și completările ulterioare;
- Prevederile art. 1 și 2 din Ordonanța Guvernului nr. 112/ 2000 pentru reglementarea procesului de scoatere din funcțiune, casare și valorificare a activelor corporale care alcătuiesc domeniul public al statului și al unităților administrativ-teritoriale;
- Prevederile Hotărârii Guvernului nr. 841/ 1995 privind procedurile de transmitere fără plată și de valorificare a bunurilor aparținând instituțiilor publice, actualizată, alin. 1.2 din Anexa nr. 2 -Regulament privind valorificarea bunurilor scoase din funcțiune aparținând instituțiilor publice, Cap. 1;
- Referatul nr.78509/08.12.2010 al Serviciului Administrare și Inventarierea Patrimoniului, Fond Locativ și îndrumare Asociații Proprietari;
- Adresa nr: 6773/ 03.11.2010, înregistrată la Primăria Municipiului Bacău cu nr. 65841/ 04.11.2010 a SC CET SA Bacău completată de adresa nr. 7321/ 07.12.2010, înregistrată la Primăria Municipiului Bacău cu nr. 83353/ 07.12.2010;
- Hotărârea Consiliului de Administrație al SC CET SA Bacău nr. 640/ 27.07.2010;
- Hotărârea Adunării Generale Ordinară a Acționarilor SC CET SA Bacău nr. 469/ 27.07.2010;
- Prevederile art. 47 si art. 117 lit. „a” din Legea nr. 215/ 2001 privind administrația publică locală republicată, ulterior modificată și completată;
- Expunerea de motive a Primarului Municipiului Bacău;

în baza dispozițiilor art. 36 alin. (2) lit. "c” și ale art. 45 (3) din Legea nr. 215/ 2001 a administrației publice locale republicată și ulterior modificată și completată:

HOTĂRĂȘTE :

ART. 1 - Se aprobă trecerea din domeniul public în domeniul privat al municipiului Bacău a bunurilor - mijloace fixe și obiecte de inventar date în concesionare către SC CET SA Bacău, prezentate în Anexele nr. 1, nr. 2 și nr. 3, părți integrante din prezenta hotărâre.

ART. 2 - Se aprobă scoaterea din funcțiune și valorificarea bunurilor - mijloace fixe prevăzute în Anexele nr. 1 și nr. 2 la prezenta hotărâre prin vânzare la licitație sau după caz casarea lor în condițiile legii, acestea fiind uzate fizic și moral și respinse la verificarea metrologică.

ART. 3 - Se aprobă casarea bunurilor - mijloace fixe prezentate în Anexele nr. 1 și nr. 2 la prezenta hotărâre, în cazul în care nu vor fi valorificate prin licitație.

ART. 4. - Sumele încasate din valorificarea bunurilor vor fi utilizate în sistemul centralizat de încălzire al municipiului Bacău, după deducerea cheltuielilor efectuate pentru îndeplinirea procedurilor de scoatere din funcțiune, valorificare și casare.

ART. 5 - Se aprobă scoaterea din uz a bunurilor materiale, prezentate în Anexa nr. 3 la prezenta hotărâre, piese de schimb și subansamble și transformarea acestora în deșeuri, cu uzură 100%, bunuri care au fost casate intern și folosite ca piese de schimb, dar nu mai corespund tehnic și funcțional.

ART. 6 - Se aprobă ca membrii comisiilor de evaluare a bunurilor, licitație și casare să fie desemnați prin Dispoziție a Primarului municipiului Bacău.

ART. 7. - Se modifică în mod corespunzător Hotărârea Consiliului Local al Municipiului Bacău nr. 111/ 2007, în sensul scoaterii acestor bunuri - mijloace fixe din inventarul domeniului public al municipiului Bacău.

ART.8 -Hotărârea va fi comunicată Serviciului Administrare și Inventarierea Patrimoniului, Fond Locativ și îndrumare Asociații Proprietari, Direcției Juridice și Administrație Locală, precum și SC CET SA Bacău.
